Below is the contract that we ask all our guests to
sign. We send this out to all our guests to sign before
you send your final payment in September/October. Have
a read through - it's pretty self explanatory, but if
you have any questions about what we've put, please
ask.
This contract is between Planet Subzero Ltd, of 19 Tylers Acre Avenue, Edinburgh, EH12 7JE and:

1. What Planet Subzero Ltd offer:
a. Planet Subzero Ltd provide long stay and seasonal
accommodation in chalets and apartments in the French
Alps, as advertised on our website, www.planetsubzero.com
b. Planet Subzero Ltd provide fully equipped accommodation
only.
c. Planet Subzero Ltd are not a tour operator.
d. Planet Subzero Ltd, it's employees and associated
provide all reasonable assistance prior to and during
your stay, as advertised. Additional services are provided
as advertised on our website, free of charge.
2. Booking with Planet Subzero Ltd:
a. To make a booking, complete and return our application
form to Planet Subzero Ltd at 19 Tylers Acre Avenue, Edinburgh, EH12 7JE. To book with Planet Subzero Ltd,
you must complete an application form and return this
to us with your deposit cheque. All initial deposits
are non-refundable. Prices are advertised on the application
form or as confirmed in writing by email. Planet Subzero
Ltd will confirm your place in our accommodation by
email.
b. Final payment must be made in full by the end of
October 2007, unless an alternative arrangement has
been agreed in writing prior to this date. If payment
is not received by 15 November 2007, and no other arrangement
has been made, Planet Subzero Ltd reserve the right
to sell your space to another party.
c. Planet Subzero Ltd reserve the right to make changes
to prices in the event of changes in exchange rate,
legislation, UK or French law, or any other event leading
to a significant price increase. Planet Subzero Ltd
will absorb price increases up to 5%. Planet Subzero
Ltd will notify you of any price increases and offer
you the opportunity to cancel with full refund. Planet
Subzero Ltd guarantee not to increase prices less than
2 months before the start of your stay.
3. Cancellation by Planet Subzero Ltd:
a. In the unlikely event of a cancellation by Planet
Subzero Ltd, you will be given the option of alternative
accommodation (of an equal or better standard), alternative
dates (where appropriate), or a full refund.
b. Planet Subzero guarantee not to cancel less than
2 months before your arrival date, except in the event
of force majeur (eg destruction of the property through
fire, flood, avalanche, war, or any other circumstance
making it impossible for you to stay in the accommodation
provided). In such circumstances, Planet Subzero Ltd
reserve the right to cancel at any time and a full refund
will be issued. Where possible, assistance and alternative
accommodation will be provided.
4. Changes to what Planet Subzero Offer:
a. Planet Subzero Ltd guarantee to notify you of any
significant change in what we offer. Where appropriate,
Planet Subzero Ltd will offer discretionary compensation
for significant changes.
b. Some of Planet Subzero Ltd's advertised services
(eg trips to other resorts) may be subject to change
at short notice (eg due to weather conditions).
c. Planet Subzero Ltd reserve the right to make changes
to what we offer at any time.
5. Cancellation by you:
a. If you decide to cancel your place with Planet Subzero
you must notify us in writing as soon as possible. All
initial deposits are non-refundable.
b. Refunds for cancellations if you have already paid
in full are at the discretion of Planet Subzero Ltd
and cannot be guaranteed. We highly recommend you take
out a comprehensive travel insurance policy at the time
of final payment, in case you are unable to travel at
the last minute (eg through illness or injury).
6. Responsibility:
a. Planet Subzero Ltd have taken all reasonable steps
to ensure that our programme is delivered as advertised,
and that that our suppliers provide a service of the
highest standard, conforming to the legal regulations
of the country in which they operate.
b. If any part of the Planet Subzero Ltd programme is
not delivered as advertised, and without prior notice
of change, we will offer alternative arrangements to
the same standard or offer a refund or part refund.
c. Planet Subzero Ltd (and our associates) do not accept
any responsibility for you, anything you do, or anything
that happens to you during your stay. Planet Subzero
Ltd accepts no responsibility for your death, injury,
illness, or arrest. Planet Subzero Ltd accepts no responsibility
for the damage to, loss, or theft of your possessions.
Planet Subzero Ltd do not accept responsibility for
any damages to property occurring as the result of your
(or any other party's) actions. Planet Subzero Ltd do
not accept responsibility for any accident/injury occurring
while skiing/boarding with us (or our associates), or
while travelling in one of our vehicles.
d. Planet Subzero Ltd reserves the right to evict you
from our accommodation at any time, without notice or
refund in the event of offensive, illegal, or dangerous
behaviour towards us, our associates, the other housemates,
the accommodation, or any other party.
e. In the event of medical or other emergency, Planet
Subzero will endeavor to offer you (and your family)
all reasonable assistance, support and advice.
7. The accommodation, travel, insurance and other:
a. Planet Subzero Ltd's accommodation is provided as
advertised on our website.
b. Sheets and duvets with covers are provided in all
our accommodation, but towels are not. You are responsible
for washing your own sheets during your stay and for
leaving clean sheets on the bed at the end of your stay.
c. Planet Subzero Ltd provide all advertised facilities
(TV, video, playstation2, internet connection etc) and
basic cleaning materials. Planet Subzero Ltd do not
guarantee to replace these in the event of misuse.
d. You and the other housemates accept responsibility
for the upkeep and cleaning of the property during the
season. You (and the other housemates) accept responsibility
for maintaining a reasonable level of tidiness, cleanliness
and noise.
e. You and the other housemates accept responsibility
for leaving the accommodation at the end of your stay
in the same condition as when you moved in.
f. You and the other housemates accept responsibility
for the safekeeping of your personal possessions as
well as the shared items in the property.
g. You and the other housemates must each provide a
security deposit cheque before you arrive in resort
for £250, made payable to Planet Subzero Ltd.
All security deposits are refundable at the end of the
season, subject to any deductions for damages, cleaning
or losses in the property. Unless one person/group of
people admit(s) liability for damages and pays for repairs
/ replacements themselves, all deductions at the end
of the season will be shared between all of the housemates
and will be made proportionate to the length of your
stay. All security deposits will be returned as soon
as the property has been checked and signed by the owner
(or by the 1st June 2007).
h. Any loss or damages must be reported to Planet Subzero
Ltd immediately so that we can provide a replacement
or repair. Minor loss or damages (eg a broken plate)
will normally be considered wear and tear and no charge
will be made, subject to the discretion of the owners
or the agents acting on their behalf.
i. Planet Subzero Ltd properties are non smoking.
j. Illegal drugs may not be used or kept in Planet Subzero
properties.
k. Planet Subzero Ltd and its associates may enter the
properties at any time without notice. Planet Subzero
Ltd or its associates will check the property condition
and contents regularly during the season to ensure the
property remains in good condition.
l. You may invite paying guests to stay in the accommodation,
subject to availability and the discretion of Planet
Subzero Ltd. The maximum number of occupants must not
be exceeded at any time. Les Arcs Chalet Henry - 7,
Les Arcs Chalet Olivier - 8, Les Chamonix Argentiere
- 10.
m. Internet access and incoming phone line is provided
in our accommodation free of charge, as advertised.
Planet Subzero Ltd do not supply computers.
n. For guests staying in Tignes and Les Arcs, you are
responsible for getting to Bourg St Maurice train/bus
station. For guests staying in Chamonix, you are responsible
for getting to Chamonix train/bus station. Planet Subzero
Ltd will organise free transport to and from these stations
to your accommodation at the start and end of your stay.
If you do not arrive on a designated 'transfer' day,
we will do our best to meet you, but cannot guarantee
it. You are responsible for informing Planet Subzero
Ltd of your arrival time.
o. You are responsible for organizing your own travel
insurance for the duration of your stay, including cover
of any personal items. You are responsible for providing
the details of your travel insurance to Planet Subzero.
p. You may choose to leave a Planet Subzero property
at any time. No refund will be issued. It is your responsibility
to ensure that your travel insurance covers the cost
or part cost of your stay in the event of you leaving
through illness, injury or any other reason. In the
event of illness or injury, Planet Subzero Ltd will
take all reasonable steps to provide advice, support,
and confirmation of your booking to any party reasonably
requiring it.
q. Planet Subzero Ltd may occasionally use photos or
images on our website or in our advertising material
that are not of the resorts or properties in our programme.
Unless otherwise specified by you, any photos of you
taken during your stay may be used by Planet Subzero
Ltd on our website or in advertising or promotional
material.
r. This contract applies under both UK and French law.
